As of August 13th, 2026, A major federal court ruling in Silencer Shop Foundation v. ATF is now taking effect, marking a significant change in how qualifying suppressor transfers may be handled.
The court ruled that continued enforcement of the National Firearms Act’s registration requirements could not be justified on the government’s taxing authority after Congress reduced the applicable NFA tax to $0.
The ruling, however, is not a blanket nationwide removal of suppressors from the NFA for every gun owner. The court declined to issue nationwide relief, and the practical effect depends on whether a purchaser and transaction fall within the scope of the court’s injunction.
For qualifying transactions covered by the ruling, suppressors may be transferred without the traditional Form 4, fingerprints, NFA approval period, and federal NFA registration process.
This is a rapidly developing legal situation. Buyers and dealers should verify that a transaction qualifies under the injunction and comply with all other applicable federal, state, and local requirements.
